1. The service
Aliax provides a browser-automation execution layer (the “Service”) consumed via SDKs and HTTP API. We may update the Service at any time; we'll notify account holders by email at least 30 days before material changes to these Terms take effect. The Aliax SDKs (Node and Python) are separately distributed under the MIT license — the MIT license governs the SDK source; these Terms govern the hosted Service.
2. Account
You're responsible for activity under your account and for keeping your API keys secret. Notify security@aliax.xyz within 24 hours of any suspected compromise.
3. Acceptable use
You agree not to use the Service to (a) circumvent third-party access controls in violation of applicable law or the target site's published terms of service, (b) scrape personal data at scale in violation of the source site's terms, (c) generate spam, fraud, or CSAM, or (d) provide the Service to persons or entities in jurisdictions subject to US export controls or OFAC sanctions. We may suspend accounts that violate this clause, with prorated refund of unused credits.
4. Billing
Pay-as-you-go top-ups are non-refundable but never expire while the account is active. Billing, top-ups, and cancellation are self-serve from the dashboard. Enterprise contracts are billed per the order form. Failed charges may pause API access until resolved.
5. Customer data & annotation IP
You retain all rights to data you submit. We process it solely to deliver the Service per our Privacy Policy. A Data Processing Addendum is available on request.
Annotation outputs (human labels produced by Aliax annotators on your captured screenshots) are licensed back to you for use in your own agent training. Aliax retains the right to use anonymized, aggregated annotation patterns to improve the Aliax system prompt. Raw customer screenshots are never used for model training without explicit written consent.
6. Service levels
Free and pay-as-you-go tiers target 99.9% monthly availability of the parseUi, execute, and captureFailure HTTP endpoints, measured at the Cloudflare edge, on a best-effort basis. Enterprise contracts include a written SLA with service credits and a defined measured surface.
7. Warranty disclaimer
The Service is provided “as is”. We disclaim implied warranties to the maximum extent allowed by law.
8. Liability cap
Our aggregate liability for any claim is capped at the fees you paid in the 12 months before the claim arises, with a minimum of $500. We're not liable for indirect or consequential damages.
9. Termination
Either party may terminate for convenience with 30 days' notice. We may terminate immediately for material breach of Section 3 (Acceptable use).
10. Governing law
These terms are governed by the laws of Delaware, USA, without regard to conflict-of-laws rules. Disputes go to the state and federal courts of New Castle County, Delaware. Enterprise contracts may designate an alternative dispute venue by mutual agreement.
